Notice of Permit PUBLIC NOTICE OF ISSUANCE OF PERMIT PURSUANT RULE 62 110.106(10)(A) STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION NOTICE OF AGENCY ACTION The Florida Department of Environmental Protection (Department) gives notice of its issuance of an Environmental Resource Permit (Permit No. 44- 0275613-003-EI) to Baker Rd 26 Real Estate Trust 11/21/2025, c/o Gregor Emmert, 2620 Falmouth Rd, Toledo, OH 43615, on April 22, 2026. Project Description & Location: This permit authorizes the placement of 4,014 sq. ft./525 cy. of fill with an associated retaining wall around the perimeter, of which 3,740 sq. ft./500 cy. is within wetlands, for the construction of a single-family residence and the installation of a 1,000 sq. ft. t-dock with two (2) boat lifts. 22,240 sq. ft. (0.51 acres) of wetlands will remain on-site. This permit authorizes 4,740 ft² of impacts to wetland or other surface waters. Submerged Resources are not located within the project boundaries; therefore, there will be no adverse impacts to these resources. The activities authorized by this Permit are located within wetlands and Dispatch Creek, Class III Waters, adjacent to 26 Baker Road, Key Largo (Section 13, Township 59 South, Range 40 East), in Monroe County, Florida. Notice of Administrative Rights: The Department’s action is final and effective on the date filed with the Clerk of the Department unless a petition for an administrative hearing is timely filed under Sections 120.569 and 120.57 of the Florida Statutes (F.S.) before the deadline for filing. On the filing of a timely and sufficient petition, this action will not be final and effective until a subsequent order of the Department. A person whose substantial interests are affected by the Department’s action may petition for an administrative proceeding (hearing) under Sections 120.569 and 120.57, F.S.. Pursuant to Rules 28-106.201 and 28-106.301, Florida Administrative Code (F.A.C.), the petition must contain specific information regarding the disputed issues of material fact, the specific rules or statutes requiring reversal, and the relief sought. Time Period for Filing a Petition: Petitions filed by any persons other than those entitled to written notice under Section 120.60(3), F.S., must be filed within 21 days of publication of this notice or within 21 days of receipt of written notice, whichever occurs first. The petition must be filed (received by the Clerk) in the Office of General Counsel of the Department, 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at Agency_ Clerk@dep.state.fl.us. A copy of the petition must also be mailed to the applicant at the address indicated above at the time of filing.
